STF intensifies repression against acts considered destabilizing

In a decision that echoes the bitter lessons of January 8, Minister Alexandre de Moraes, of the Federal Supreme Court (STF), ordered the prohibition of any camps or demonstrations in the vicinity of the Papuda Penitentiary Complex, in Brasília. The measure, handed down this Wednesday (23), also authorizes the arrest in the act of protesters who resist the order, marking a hardening of the Judiciary's stance towards acts that could compromise security and institutional order.

The decision by Moraes, rapporteur of the inquiry that investigates the coup plot in 2022 and 2023, comes in response to a representation from the Attorney General's Office (PGR). The ministerial body warned of a possible 'walk' promoted by federal deputy Nikolas Ferreira (PL-MG) and other supporters, which could culminate in acts close to the prison complex, where some investigated and convicted of anti-democratic attacks are being held.

The minister's reasoning leaves no room for doubt. Moraes recalled that the attempted coup d'état on January 8, 2023 had, as one of its main factors, the 'omission of several public authorities, who allowed the illegal coup camps in front of the Army barracks'. This state failure to curb demonstrations prior to violent acts is now used as a justification for preventive and incisive action.

"It is unreasonable to repeat the regrettable previous error of allowing criminals to organize and remain in coup camps freely", stated the minister in his order, as reported by Folha de S. Paulo.

Moraes' order is not just a ban on camps; it represents a clear message that the Judiciary will not tolerate the repetition of scenarios that, in the recent past, degenerated into attacks on democracy. The precedent of January 8, where the inaction of part of the security forces allowed the escalation of violence and the depredation of the headquarters of the Three Powers, now serves as a guide for firmer actions. For Portal Cunho, the decision reflects the tension between the right to free expression and the need to protect institutions from threats to their integrity.

The practical consequences of the measure are immediate. Any individual or group that attempts to set up structures or carry out protests in the delimited areas may be arrested. This movement, although it aims to guarantee public order, raises questions about the limits of freedom of expression and the interpretation of what constitutes a coup or destabilizing act, especially when political figures such as Nikolas Ferreira are involved. The clash between judicial power and popular representation is intensifying, with the STF seeking to retain the reins of political stability.

In the coming days, attention will be focused on monitoring order and the reaction of the groups planning the demonstrations. Moraes' decision not only prevents possible disorders in Papuda, but also raises a warning about how Justice will act in the face of future mobilization attempts that flirt with illegality. It remains to be seen whether this hard line will be enough to contain tempers and whether new chapters of this dispute between powers will emerge on the national political scene.
